What is an Agent under Power of Attorney?
An Agent under a Power of Attorney (POA) is a person or entity authorized to manage a client’s financial and legal affairs if the client becomes incapacitated or unable to act on their own behalf. This role ensures decisions can still be made to protect the client’s interests and their bills are paid during their lifetime.
When Does This Role Become Active?
The authority of an Agent typically becomes active once the client decides they would like financial assistance, is deemed incapacitated or unable to manage their own affairs, or as specified in the Power of Attorney document. This activation allows the Agent to step in and handle important financial and legal responsibilities immediately when needed.
Scope of Responsibilities
Agents have the power to perform a variety of tasks including paying bills, managing bank and investment accounts, selling or managing real property, and making critical financial decisions. Their role is to act prudently and in the best interest of the client, following the instructions laid out in the POA.
