What is a Trustee?

A Trustee is a person or entity appointed to manage a trust according to the specific terms outlined in the Trust document. Their responsibility is to oversee the administration and distribution of trust assets, ensuring that the wishes of the trust creator are faithfully executed.

Role of a Successor Trustee

A Successor Trustee steps in when the original Trustee is no longer able to serve—whether due to incapacity, resignation, or death. This ensures continuous, seamless management of the trust without disruption or delay. We often serve as Trustee for clients as they age or encounter medical issues and no longer want to manage their finances or trust assets, or when an acting Trustee is no longer able or willing to serve as Trustee and needs a trustworthy replacement Trustee.

Reasons for Naming a Neutral Third Party

Many clients want a neutral third-party to serve as their Trustee and choose to appoint a professional fiduciary company to avoid potential conflicts of interest, especially in cases involving blended families, distant relatives, or complex family dynamics. A professional Trustee offers impartiality, expertise, and objective oversight, providing peace of mind to the Trust creator and beneficiaries.

How Nominations Happen (Trust Document)

Clients nominate their preferred Trustee directly in the Trust document during the estate planning process with their attorney. Existing Trustees may also decline to serve or resign and appoint a professional Trustee to replace them. We are available to serve as your Trustee, step in as a replacement trustee, or support existing Trustees throughout the trust administration process.
